1. About Marsam
Marsam is a drawing, coloring, and creativity application designed to provide children and families with a fun and safe environment for creating artwork using drawing tools, colors, stickers, and other features available within the app.
2. Marsam Is Not a Free App
Marsam is a paid subscription-based application and is not a free app.
Eligible users may be offered access to the app through a 3-day free trial available through the Apple App Store.
The free trial is temporary and does not provide permanent access to paid features without a subscription.
After the free trial ends, a valid paid subscription is required to continue accessing features that require a subscription.
3. Subscription Plans
Marsam offers subscription plans that may include:
- A monthly subscription.
- A yearly subscription.
The actual price, currency, subscription period, and applicable offer terms are displayed by the App Store before the user confirms a purchase.
Prices may vary depending on the user’s country or region, currency, applicable taxes, and App Store pricing policies.
The price displayed by Apple when the user confirms the transaction is the applicable price for that transaction, subject to Apple’s terms.
4. 3-Day Free Trial
Eligible users may be offered a 3-day free trial before a paid subscription begins.
Eligibility for a free trial or introductory offer is determined by Apple.
Unless the subscription is canceled in accordance with Apple’s terms before the end of the trial and the applicable renewal time, the subscription may automatically convert into a paid subscription and the price displayed when subscribing may be charged to the user’s Apple Account.
Users should review the App Store purchase confirmation screen for the price, duration, trial conditions, and renewal terms applicable to their subscription.
5. Automatic Renewal
Marsam subscriptions are automatically renewable when presented as such through the App Store.
A subscription will continue and automatically renew for the next subscription period unless automatic renewal is canceled in accordance with Apple’s rules before the applicable renewal time.
Subscription renewal and billing are managed by Apple and not directly by Mac Winsoft.
6. Payment
All payments are processed through the user’s Apple Account when a purchase is confirmed.
Mac Winsoft does not process or store users’ credit card or bank account information.
Payments, billing, and refund policies are subject to Apple’s applicable terms and App Store policies.
7. Canceling a Subscription
Users can manage their subscription or cancel automatic renewal through the subscription settings associated with their Apple Account.
Deleting Marsam from a device does not automatically cancel a subscription.
The subscription must be canceled using the methods provided by Apple.
Continued access to paid features is subject to the subscription status provided by Apple.
8. Refunds
Because purchases are processed through the Apple App Store, payments and refund requests are subject to Apple’s refund policies.
Mac Winsoft does not control Apple’s decisions regarding whether a refund request is approved or denied.
9. Restore Purchases
Marsam may provide a Restore Purchases option that allows users to restore eligible subscriptions or entitlements associated with their Apple Account.
Restoration depends on purchase information and subscription status provided by Apple.
10. Children’s Use of Marsam
Marsam is designed to be suitable for children and families.
Subscriptions and purchases should be completed by a parent, legal guardian, or another person authorized to use the Apple Account associated with the device.
Parents or guardians who allow children to use Marsam are responsible for providing appropriate supervision.
Mac Winsoft may use appropriate mechanisms, such as a Parental Gate, to help prevent children from unintentionally accessing certain areas or actions intended for adults.
Such mechanisms are not intended to replace appropriate parental or guardian supervision.
11. Children’s and Users’ Privacy
Marsam does not require users to create a Mac Winsoft account, and Mac Winsoft does not require children or other users to provide personal information in order to use the app.
Marsam does not provide public chat, social profiles, or a Mac Winsoft service that enables children to communicate with other users.

12. User-Created Artwork
Users may create drawings and artwork using Marsam.
Artwork created by users remains theirs. Mac Winsoft does not claim ownership of artwork merely because it was created using Marsam.
Users, or their parents or guardians where appropriate, are responsible for content they create, save, or share using the app.
If a user chooses to share artwork using the device’s sharing functionality, the user is responsible for selecting the person, application, or service with which the content is shared.
13. Acceptable Use
Users agree to use the app lawfully, appropriately, and for the purposes for which it was designed.
The app may not be used in a manner that violates the rights of others or applicable laws.
Users may not attempt to disrupt the app, circumvent subscription systems, gain unauthorized access to paid features, modify or bypass protections in the app, or otherwise exploit the app in an unauthorized manner, except to the extent expressly permitted by applicable law.
14. Intellectual Property
Marsam, including its design, software, interfaces, original artwork, icons, stickers, visual elements, sounds, music, content, trademarks, logos, and other materials owned by Mac Winsoft, is protected by applicable copyright and intellectual property laws.
Except for content created by users themselves, use of the app does not grant users ownership of any part of the app or its content.
The app’s content may not be copied, redistributed, sold, republished, extracted, or used for commercial purposes without appropriate permission from Mac Winsoft, except where permitted by law.
15. License to Use the App
Subject to compliance with these Terms and maintaining a valid subscription where a subscription is required, Mac Winsoft grants the user a limited, personal, non-exclusive, and non-transferable license to use Marsam on compatible Apple devices in accordance with App Store terms.
This license is for personal, non-commercial use only unless otherwise agreed to in writing by Mac Winsoft.
16. Availability of the App and Features
Mac Winsoft seeks to provide the app and its features in a stable and reliable manner, but does not guarantee that the app will be available without interruption or errors at all times.
We may add, improve, modify, remove, or update features, the app’s design, or available content from time to time.
Some updates may require a newer version of the operating system or a compatible device.
17. Updates
Mac Winsoft may release updates to Marsam to improve performance, fix bugs, add features, or maintain compatibility with new versions of iOS and iPadOS.
Installing certain updates may become necessary in order to continue using the app or some of its features properly.
18. Apple Services
Marsam is distributed through the Apple App Store, and subscriptions and purchases are managed using Apple services.
Use of the App Store, Apple Account, and in-app purchases may be subject to additional terms and policies established by Apple.
Apple is not responsible for content provided by Mac Winsoft within the app except to the extent required by applicable laws or agreements.
19. External Services and Websites
The app or the Mac Winsoft website may contain links or provide access to external services.
Mac Winsoft does not control the content, policies, or practices of external services, and use of those services is subject to the terms and privacy policies of their respective providers.
20. Disclaimer
Marsam is provided for drawing, creativity, and entertainment purposes.
Mac Winsoft strives to provide a high-quality experience, but the app is provided on an as-available basis, to the extent permitted by law.
Mac Winsoft does not guarantee that the app will be completely free of errors or that all features will operate identically on all devices or operating system versions.
Nothing in these Terms affects any mandatory legal rights that consumers may have and that cannot be excluded or limited under applicable law.
21. Limitation of Liability
To the maximum extent permitted by applicable law, Mac Winsoft will not be liable for indirect, incidental, special, or consequential damages resulting from the use of, or inability to use, the app.
No exclusion or limitation of liability contained in these Terms applies where applicable law prohibits such exclusion or limitation.
22. Responsibility for Saving Artwork
Users should save or export important artwork using the options available within the app when they wish to retain it.
Mac Winsoft does not guarantee that artwork can be recovered if it is deleted from the device or lost as a result of deleting the app, losing or damaging the device, changing device settings, operating system issues, or storage-related problems.
23. Suspension or Termination of Access
Mac Winsoft may restrict or terminate access to the app or certain services where necessary due to misuse of the app, attempts to circumvent subscription systems, violation of these Terms, or for security or legal reasons.
This does not affect the user’s legal rights relating to purchases made through Apple.
24. Discontinuation of the App or Service
Mac Winsoft may decide in the future to discontinue the app or certain features, subject to applicable legal and contractual obligations and the rights of users and subscribers.
If such discontinuation affects active subscriptions, they will be handled in accordance with applicable Apple rules and policies and applicable law.
25. Changes to Prices and Subscriptions
Subscription prices or available plans may change in the future.
Any changes to subscription prices will be made in accordance with Apple’s mechanisms and policies, and notices or user approval will be provided where required by Apple’s rules or applicable law.
26. Changes to These Terms of Use
Mac Winsoft may update these Terms of Use from time to time to reflect changes to the app, its features, or legal requirements.
The updated version will be published on the Mac Winsoft website, and the “Last Updated” date will be revised accordingly.
Continued use of the app following an update will be subject to the then-current Terms, subject to any legal requirements regarding notice to users or obtaining their consent.
27. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that finding will not affect the validity of the remaining provisions, and the rest of these Terms will remain in effect to the extent permitted by law.
28. Entire Agreement
These Terms of Use, together with the Privacy Policy and the applicable Apple terms governing the App Store, subscriptions, and purchases, constitute the framework governing the user’s use of Marsam.
